These Terms of Service ("Terms") govern your use of the silvermatrix fitness centres and related services provided by silvermatrix B.V., a company registered in the Netherlands with registration number 90672943 ("Company", "we", "us", or "our").

Acceptance of Terms

By accessing our facilities, using our services, or creating a membership account with silvermatrix, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services or access our facilities. These terms apply to all members, guests, and visitors to our fitness centres.

Membership and Services

silvermatrix offers various membership tiers and fitness services including:

• Access to fitness equipment and facilities
• Group fitness classes and training programmes
• Personal training services
• Wellness and recovery services
• Multi-location access (depending on membership tier)

Membership benefits, pricing, and terms may vary by location and membership type. All membership details will be clearly communicated at the time of enrolment and are subject to these Terms of Service.

Member Obligations

As a member of silvermatrix, you agree to:

• Provide accurate and complete information during registration
• Follow all facility rules, safety guidelines, and staff instructions
• Treat all equipment, facilities, and other members with respect
• Maintain appropriate fitness attire and hygiene standards
• Not engage in any disruptive, dangerous, or inappropriate behaviour
• Pay all fees and charges on time according to your membership agreement
• Notify us immediately of any changes to your contact information
• Use our services only for their intended purpose

Facility Rules and Safety

For the safety and enjoyment of all members, the following rules apply:

• Members must be at least 16 years of age (minors require parental consent)
• Proper athletic footwear and appropriate workout attire are required
• Equipment must be used properly and returned to designated areas after use
• Personal training is available only from certified silvermatrix trainers or approved partners
• Photography and recording are prohibited without express written permission
• Smoking, alcohol, and illegal substances are strictly prohibited
• Members are responsible for their personal belongings

Health and Medical Considerations

You acknowledge that physical exercise involves inherent risks and you participate at your own risk. You represent that you are physically able to participate in fitness activities and have no medical conditions that would prevent safe participation. We strongly recommend consulting with a healthcare provider before beginning any fitness programme. silvermatrix staff are not medical professionals and cannot provide medical advice.

Payment Terms

Membership fees are due in advance according to your chosen payment schedule. We accept various payment methods including direct debit, credit cards, and bank transfers. Late payments may result in suspension of membership privileges and additional fees. You are responsible for ensuring your payment information is current and accurate.

Intellectual Property

All content, materials, trademarks, logos, and intellectual property associated with silvermatrix are owned by or licensed to silvermatrix B.V. You may not reproduce, distribute, modify, or create derivative works from any of our intellectual property without express written permission. This includes but is not limited to our training programmes, facility designs, marketing materials, and proprietary fitness methodologies.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the fullest extent permitted by law, silvermatrix B.V. shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our facilities or services. This includes but is not limited to personal injury, property damage, or loss of data. Our total liability to you for any claim shall not exceed the amount you have paid for your membership in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless silvermatrix B.V., its employees, agents, and affiliates from any claims, damages, losses, or expenses arising from your use of our facilities, violation of these Terms, or infringement of any third-party rights.

Termination

Either party may terminate the membership agreement with appropriate notice as specified in your membership contract. silvermatrix reserves the right to immediately terminate or suspend your membership for violation of these Terms, non-payment, or behaviour that endangers the safety or enjoyment of other members. Upon termination, you must return any access cards or equipment and your right to use our facilities immediately ceases.

Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to members via email or posted notices at our facilities. Continued use of our services after such modifications constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms or your membership shall be subject to the exclusive jurisdiction of the Dutch courts. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Force Majeure

silvermatrix shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemic restrictions, or other force majeure events.
